A Chinese tech firm claims they own the trademark to the ?iPad? and are seeking a ban on exports of the product from China. The Chinese are not only a huge consumer of the iPad and other Apple products, but they are also the largest production base for the iPad, iPhone, and iPod.
Proview Technology Co Ltd operate of the nation?s manufacturing capitol of Shenzhen. The company is petitioning Chinese customs to stop the shipment of the iPads in and out of the country.
Authorities have already told retailers in some cities to cease sale of the iPad due to the legal dispute. Apple, however says that they bought the rights to the trademark long ago.
?We bought Proview?s worldwide rights to the iPad trademark in 10 different countries several years ago. Proview refuses to honor their agreement with Apple in China and a Hong Kong court has sided with Apple in this matter,? said an Apple Saleswoman.
Proview is expected to win the case, receiving a pay out from Apple. The tech giant does have some bargaining power, though, as it is the only company that can buy the iPad name from Proview.
Some blame Apple?s lawyers, saying they should have been more careful in the trademark laws in China. Others say that Apple?s lawyers took the right approach, using the brand name and only worrying about the trademark when it became enough of an issue.
