Tiny lizard threatens oil production in West Texas

MIDLAND ? In West Texas, the roar of drilling rigs is the sound of money.

"This is one of the quieter rigs I've worked on," said Wylie Stokes as he raised his voice on a toasty spring day.

Stokes is in charge of a small team drilling for oil two miles below the Permian Basin.

"Two years ago, it was hard coming across a job," he remembered.

The recession put him out of work for nine months before he found this work.

Now a little lizard, known as the Dunes Sagebrush Lizard, has him worried once more.

"I hadn't seen one until last week when I looked it up on the Internet to see what all the fuss was about," Stokes said.

This species is barely three inches long and the federal government might soon declare it endangered.

"Personally it would ruin a whole lot of us unless we can find another industry where we can do what we know to do," Stokes said.

But Texas oil and gas producers said listing the lizard could decimate their industry, cut production, and cost jobs.

"Those rigs support about 150 jobs each," said Steven Pruett, president of Legacy Reserves. "If you multiply that by the 132 rigs, that's about 20,000 direct jobs that could be impacted by a listing."

At issue is where the lizard lives. It is the Shinnery Oak, a tree that looks like a bush.

But the problem is oil and gas drillers often inadvertently destroy it when they move in equipment and clear space.

Without the Shinnery Oak, the U.S. Fish & Wildlife Service said this lizard cannot survive.

A declaration of endangered species would tighten restrictions on the oil and gas industry.

"You couldn't build roads, you couldn't lay electric lines, you couldn't lay pipelines. You couldn't put in drilling locations, I mean, we're shut down," said Douglass Robison, president of EXL Petroleum. "There's no way to operate without doing those operations. It would be like someone saying you can build a highway, but you can't grade it or pave it."

Specific restrictions have not been formulated by the U.S. Fish & Wildlife Service.

Lizards have roamed the dusty landscape of West Texas for 15,000 years.

The energy industry says the feds don?t yet know enough about this species to declare it endangered.

How many are still alive? No one knows. It is impossible to conduct a lizard census. But development has destroyed a quarter of the Shinnery Oak habitat and experts figure that might have wiped out a quarter of the little reptiles.

Conservationists are now concerned that without protection, the Dunes Sagebrush lizard could go extinct.

"The lizard is part of the web of life," said John Horning, executive director of? WildEarth Guardians.

Horning's group is trying to protect the lizard.

He said oil and gas producers are overstating the crisis and declaring the lizard endangered would not destroy the industry.

"They're pulling that out of thin air," Horning said. "If you believe that you're just as likely to believe this three-inch lizard is going to be Godzilla the moment the endangered species act protections go into place."

Horning said not every well and drill site in the Permian Basin would be affected, but rather only a sliver of them where Shinnery Oak exists.

"They can extract every last drop," Horning added. "We're saying let's not destroy every last acre of this lizard's habitat."

More crude is pumped out of the Permian Basin than anywhere else in the Continental U.S.

But experts explained the price at the pump is set on the global market and not what happens in West Texas.

The U.S. Fish & Wildlife Service said it will have a decision by December on whether to add this lizard to the endangered species list.

Companies and conservationists hope agreements can be reached before then to both protect Shinnery Oak and keep drilling.

Jobs remain the chief concern for Wylie Stokes.

"We might go extinct along with that lizard if we're not careful," Stokes said.

Former Tijuana mayor ordered released from prison (AP)

TIJUANA, Mexico ? A federal judge ordered the release of former Tijuana Mayor Jorge Hank Rhon early Tuesday, saying officials lacked evidence to charge him with illegal weapons possession after a military raid on his house.

The 55-year-old gambling magnate had been held since the June 4 raid on his Tijuana house, beside a racetrack and casino. Hank Rhon is part of a prominent clan in the Institutional Revolutionary Party that is trying to regain Mexico's presidency next year's election.

Judge Blanca Evelia Parra Meza also ordered the release of eight people arrested with Hank Rhon and the dismissal of charges against all 11 who were picked up in raid. Two had been released last week. It was not clear early Tuesday if Hank Rhon had left the prison.

According to a court statement, the judge said there was not enough evidence presented before time ran out on the constitutional limit for holding Hank Rhon and the others on charges of illegal possession of weapons, ammunition and possession of weapons for use only by the military.

It says the ruling can be appealed.

With the raid on Hank Rhon's home, prosecutors had gone after a man with deep roots in Mexico's elite who had long been considered untouchable.

But the unusual circumstances of the raid, coming in the run-up to an election season, left federal officials scrambling to deny it had political motivations.

U.S. officials have long been suspicious of the Hank clan, and the flamboyant Hank Rhon in particular. Gambling can be a prime way to launder money, and Hank Rhon runs a gaming empire based in one of the world's busiest drug-trafficking corridors. However they have never indicted him on any corruption-related charge.

Mexico's military said it found 88 weapons and nearly 10,000 rounds of ammunition during the raid. Federal prosecutors said only 10 of the weapons were licensed. The prosecutor of Mexico's Baja California state later said that ballistic tests showed that two of the guns found had been used in homicides.

Hank Rhon denied any knowledge of the guns and his lawyer has said none of the guns seized were Hank Rhon's.

The judge's order came at about 3:20 a.m. (6:20 a.m. EDT; 1020 GMT). His lawyers were still outside the prison later in the morning, along with a Maserati used by the tycoon.

Hundreds of supporters of the flamboyant politician also gathered in anticipation of a celebration.

Hank Rhon's attorneys argued that soldiers needed a search warrant to enter the sprawling compound in central Tijuana around 3 a.m. on June 4 and that failure to get one merited dismissal of the charges without even considering the 40 rifles, 48 handguns, 9,298 bullets, 70 ammunition clips and a gas grenade that were seized.

It was not clear early Tuesday if officials might try to re-arrest Hank Rhon on other charges.

Hank Rhon still faces questions over two of the seized guns that authorities have linked to the Tijuana killings of a security guard in December 2009 and an alleged car thief in June 2010. The Baja California state attorney general's office has given no timetable for completing its investigation into the two deaths.

The ruling alone will likely be viewed as a stinging setback for the administration of President Felipe Calderon as it tries to prosecute organized crime in Mexican courts.

It echoes another major blow: the federal attorney general's office arrested 12 mayors and 23 other officials in 2009 for supposedly aiding the Michoacan-based La Familia drug cartel, only to see judges set them all free, the last one in April.

"It's going to be a huge embarrassment to the Calderon administration," said David Shirk, director of the University of San Diego's Trans-Border Institute and an expert on the Mexican judicial system. "It's not so much that they made a mistake. It's that they have not been able to convict a noticeable number of organized crime suspects."

Hank Rhon's supporters, including members of his party, criticized the army for how it carried out the raid, hustling Hank Rhon, his wife and their children from bed before dawn. Catholic Church leaders came to the former mayor's defense.

"I have confidence in God that everything will be conducted in accordance with the law and you will soon be back with your family and us again," Tijuana Archbishop Rafael Romo wrote in a letter to Hank Rhon that was published Monday in Mexican newspapers.

Supporters collected tens of thousands of signatures demanding Hank Rhon's release during a four-day stakeout at a parking lot.

They planned to hold a celebration at Hank Rhon's Grupo Caliente racetrack upon his return to Tijuana after nearly a week and a half in custody.

Nearly two years ago, Bob Dylan had a motorcycle accident. Reports of his condition were vague, and he dropped out of sight. Publication of his book, Tarantula, was postponed indefinitely. New records appeared, but they were from his last album, Blonde on Blonde. Gruesome rumors circulated: Dylan was dead; he was badly disfigured; he was paralyzed; he was insane. The cataclysm his audience was always expecting seemed to have arrived. Phil Ochs had predicted that Dylan might someday be assassinated by a fan. Pete Seeger believed Dylan could become the country's greatest troubadour, if he didn't explode. Alan Lomax had once remarked that Dylan might develop into a great poet of the times, unless he killed himself first. Now, images of James Dean filled the news vacuum. As months passed, reflex apprehension turned to suspense, then irritation: had we been put on again? We had. Friends began to admit, with smiles, that they'd seen Bobby; he was rewriting his book; he was about to sign a contract with MGM Records. The new rumor was that the accident had been a cover for retreat. After Blonde on Blonde, his intensive foray into the pop demimonde, Dylan needed time to replenish his imagination. According to a less romantic version, he was keeping quiet till his contracts expired.

The confusion was typical. Not since Rimbaud said "I is another" has an artist been so obsessed with escaping identity. His masks hidden by other masks, Dylan is the celebrity stalker's ultimate antagonist. The original disparity between his public pose as rootless wanderer with southwestern drawl and the private facts of home and middle-class Jewish family and high school diploma in Hibbing, Minnesota, was a commonplace subterfuge, the kind that pays reporters' salaries. It hardly showed his talent for elusiveness; what it probably showed was naivete. But his attitude toward himself as a public personality was always clear. On an early recording he used the eloquent pseudonym "Blind Boy Grunt." "Dylan" is itself a pseudonym, possibly inspired by Dylan Thomas (a story Dylan now denies), possibly by a real or imaginary uncle named Dillon, who might or might not be the "Las Vegas dealer" Dylan once claimed was his only living relative.

In six years Dylan's stance has evolved from proletarian assertiveness to anarchist angst to pop detachment. At each stage he has made himself harder to follow, provoked howls of execration from those left behind, and attracted an ever-larger, more demanding audience. He has reacted with growing hostility to the possessiveness of this audience and its shock troops, the journalists, the professional categorizers. His baroque press conference inventions are extensions of his work, full of imaginative truth and virtually devoid of information. The classic Dylan interview appeared in Playboy, where Nat Hentoff, like a housewife dusting her furniture while a tornado wrecks the house, pursued the homely fact through exchanges like: "Do you have any unfulfilled ambitions?" "Well, I guess I've always wanted to be Anthony Quinn in La Strada. . . . I guess I've always wanted to be Brigitte Bardot, too; but I don't really want to think about that too much."

Dylan's refusal to be known is not simply a celebrity's ploy, but a passion that has shaped his work. As his songs have become more introspective, the introspections have become more impersonal, the confidences of a no-man without past or future. Bob Dylan as identifiable persona has been disappearing into his songs, which is what he wants. This terrifies his audiences. They could accept a consistent image ? roving minstrel, poet of alienation, spokesman for youth ? in lieu of the "real" Bob Dylan. But his progressive self-annihilation cannot be contained in a game of let's pretend, and it conjures up nightmares of madness, mutilation, death.

The nightmares are chimerical; there is a continuing self, the Bobby Dylan friends describe as shy and defensive, hyped up, careless of his health, a bit scared by fame, unmaterialistic but shrewd about money, a professional absorbed in his craft. Dylan's songs bear the stigmata of an authentic middle-class adolescence; his eye for detail, sense of humor, and skill at evoking the archetypal sexual skirmishes show that some part of him is of as well as in the world. As further evidence, he has a wife, son, and house in Woodstock, New York. Instead of an image, Dylan has created a magic theater in which the public gets lost willy-nilly. Yet he is more ? or less ? than the sum of his illusions.

Many people hate Bob Dylan because they hate being fooled. Illusion is fine, if quarantined and diagnosed as mild; otherwise it is potentially humiliating (Is he laughing at me? Conning me out of my money?). Some still discount Dylan as merely a popular culture hero (How can a teenage idol be a serious artist? At most, perhaps, a serious demagogue). But the most tempting answer ? forget his public presence, listen to his songs ? won't do. For Dylan has exploited his image as a vehicle for artistic statement. The same is true of Andy Warhol and, to a lesser degree, of the Beatles and Allen Ginsberg. (In contrast, James Dean and Marilyn Monroe were creatures, not masters, of their images.) The tenacity of the modern publicity apparatus often makes artists' personalities more familiar than their work, while its pervasiveness obscures the work of those who can't or won't be personalities. If there is an audience for images, artists will inevitably use the image as a medium ? and some images are more original, more compelling, more relevant than others. Dylan has self-consciously explored the possibilities of mass communication just as the pop artists explored the possibilities of mass production. In the same sense that pop art is about commodities, Dylan's art is about celebrity.

This is not to deny the intrinsic value of Dylan's songs. Everyone interested in folk and popular music agrees on their importance, if not their merit. As composer, interpreter, most of all as lyricist, Dylan has made a revolution. He expanded folk idiom into a rich, figurative language, grafted literary and philosophical subtleties onto the protest song, revitalized folk vision by rejecting proletarian and ethnic sentimentality, then all but destroyed pure folk as a contemporary form by merging it with pop. Since then rock-and-roll, which was already in the midst of a creative flowering dominated by British rock and Motown, has been transformed. Songwriters have raided folk music as never before for new sounds, new images, new subject matter. Dylan's innovative lyrics have been enthusiastically imitated. The folk music lovers who managed to evolve with him, the connoisseurs of pop, the bohemian fringe of the literary community, hippies, and teenagers consider him a genius, a prophet. Folk purists and political radicals, who were inspired by his earlier material, cry betrayal with a vehemence that acknowledges his gifts.

Yet many of Dylan's fans ? especially ex-fans ? miss the point. Dylan is no apostle of the electronic age. Rather, he is a fifth-columnist from the past, shaped by personal and political nonconformity, by blues and modern poetry. He has imposed his commitment to individual freedom (and its obverse, isolation) on the hip passivity of pop culture, his literacy on an illiterate music. He has used the publicity machine to demonstrate his belief in privacy. His songs and public role are guides to survival in the world of the image, the cool, and the high. And in coming to terms with that world, he has forced it to come to terms with him.

Now is the time for a YMCA in Mount Pleasant, according to Tom Earnhardt, a 28-year veteran physician?s assistant and Mt. Pleasant native who is Chief Operating Officer of Cabarrus Family Medicine.? He and others are trying to raise money and meeting with YMCA officials to try to establish a YMCA in Mt. Pleasant.?

Earnhardt sees patients regularly at the CFM?s Mt. Pleasant office.? One of the medical conditions Earnhardt treats there most often is arthritis ? years of farming and hard labor have wreaked havoc on many of Mount Pleasant?s residents. Access to a warm water pool could be a tremendous help, he said. ?Warm water exercise is a great form of treatment. It builds muscle strength, relaxes stiff joints and provides pain relief.?

And that?s just one of the ways a YMCA could benefit the community. Fighting childhood obesity, providing a safe place for teens to gather, offering exercise classes and other programs that enhance family and community living are a few more, he said.

Three years ago, Earnhardt undertook a campaign to establish a YMCA in Mount Pleasant. The Cannon Memorial YMCA board gave half the money for a study to see if there would be enough membership support for a Y in Mount Pleasant, and Earnhardt paid the rest out of his own pocket.??

?I felt it was so important to get the project off the ground, that I was happy to pay for half the study costs,? he said.

But he wasn?t pleased with the results. The study determined through a narrow look at the U.S. 49 and the N.C. 73 corridors that there wasn?t enough population to support a Y, Earnhardt said. But he believes that if the study had taken in a broader swath of Cabarrus County and the outlying areas into Stanly County, like Locust and Oakboro, it would have proven to be a well-supported YMCA.

The Cannon Memorial YMCA nixed the idea of a Mount Pleasant YMCA, telling Earnhardt, ?It?s a great idea, but not now.?

Earnhardt said he thinks the time has come to proceed with a health and fitness center in Mount Pleasant, whether it?s through the YMCA or another non-profit agency. He has established a board of directors for what he has named The Eastern Cabarrus Health and Recreation Center, and has appealed to the board of directors of the Cannon Memorial YMCA once again.

He said he?s not asking for money, just support through the use of the YMCA franchised name to begin fund-raising efforts. If the project doesn?t go through, the money raised will still go to the Cannon Memorial YMCA, he said. But he says he?s discouraged again because he?s been told the board is likely to return another ?not now? decision.

Earnhardt said he?s ready for a health and fitness center in Mount Pleasant, and he believes the town?s residents and people in outlying areas are too. Another option is to start filing for non-profit status and create a stand-alone health and fitness center with no YMCA connection.

But Earnhardt said he feels the Cannon Memorial YMCA brand would be ideal for Mount Pleasant.

?There are three Cannon Memorial YMCAs in the county ? one in Kannapolis, one in Concord serving West Cabarrus, and one in Harrisburg. It just makes sense for the eastern part of Cabarrus County ?to be represented with a YMCA.?

According to Earnhardt, ?There is a huge disparity of exercise facilities in Cabarrus County. With obesity on a steep upward slope, we need to take our health and well-being seriously.? ?He further quoted a report by The Clinton Foundation which states that over the past four decades, obesity rates have soared among children of all age groups, increasing nearly five-fold among those ages 6-11 and that today, nearly 25 million children are overweight or obese.? The report also states that if the obesity rates among children continues to increase, our current generation of children will become the first in American history to live shorter lives than their parents.?

??I am hopeful the Cannon Memorial YMCA will see the value and importance of establishing a facility in Eastern Cabarrus County.? I realize it will be a challenge but so are most worthwhile projects.? Adequate exercise facilities should be available to all residents of Cabarrus County and this project would go a long way in meeting that need.?

White House Counsel Bauer Exits, Replaced By Career Prosecutor

President Obama's top lawyer, Bob Bauer, is leaving the White House to return to his law firm, Perkins and Coie.

Bauer isn't leaving Obama's orbit completely, however. He will advise Mr. Obama's reelection campaign and serve as the president's personal lawyer.

He'll be replaced by a veteran prosecutor, Kathleen Ruemmler. She has spent most of her career at the Justice Department.

She started out handling drug and crime cases in Washington D.C. then then took on a leading role in the prosecution of former Enron executives.

?

Ruemmler helped run the Justice Department in the early days of the Obama administration. And since last year she's been a top deputy in the White House counsel's office, giving advice on sensitive issues such as the prison at Guantanamo Bay.

An excerpt from the White House statement:

"Bob is a good friend and has served as a trusted advisor for many years," said President Obama. "Bob was a critical member of the White House team. He has exceptional judgment, wisdom, and intellect, and he will continue to be one of my close advisors."

At the end of June, Bauer will return to Perkins Coie where he will resume his practice focused on serving as general counsel to the President's reelection campaign, general counsel to the Democratic National Committee, and personal lawyer to President Obama.

"Kathy is an outstanding lawyer with impeccable judgment," said President Obama. "Together, Bob and Kathy have led the White House Counsel's office, and Kathy will assure that it continues to successfully manage its wide variety of responsibilities."

Custom Presentation Folder Ideas? | Customized Business Cards

I will be attending a conference next month and I am putting together a demo portfolio (composer). I was wondering what ideas you guys had that would be cost effecient. Here?s what I would LIKE (but is too expensive).

- 30 Customized folders with my logo, name, and contact information on the front.
- Business card holder in the front sleeve of the folder
- CD holder in the 2nd sleeve
- Fasteners to put paper (certificate paper) information on cd, biography, scores, etc.

Now of course, the customized part is nearly 0+ alone, and I really don?t want to spend more then -80. This needs to look as professional as possible, but keep a creative idea intact.

Things I need:

- My name on front somehow that won?t look tacky
- Place to put my business card in the folder
- Area for a CD or atleast enough room to stick an adhesive CD sleeve on it.
